Caltuck LLC - Terms of Service

By creating an account or using any part of the Caltuck Cloud Monitoring platform ("Service"), you agree to be bound by the following Terms of Service ("Agreement"). If you do not agree with these terms, do not use the Service.

1. Overview of Service

The Caltuck Cloud Monitoring platform provides environmental monitoring services, including but not limited to temperature sensors, connectivity alerts, and automated SMS notifications. These services are provided "as is" for informational purposes only.

2. No Warranty or Guarantee of Detection

You understand and agree that our system is not guaranteed to detect or alert you of every possible condition or event. While we strive to maintain accurate and timely alerts, Caltuck LLC does not guarantee the performance, reliability, or accuracy of its monitoring systems or alerts.

3. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL CALTUCK LLC, ITS OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE HELD LIABLE FOR ANY DAMAGES, LOSSES, OR COSTS OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PRODUCT LOSS, BUSINESS INTERRUPTION, OR PERSONAL INJURY) RESULTING FROM A FAILURE TO DETECT OR COMMUNICATE A TEMPERATURE OR SENSOR EVENT.

This includes but is not limited to failures due to power outages, network interruptions, software errors, hardware defects, third-party dependencies, or user misconfiguration.

4. No Emergency Use

This Service is not a substitute for emergency response systems or procedures. It is not intended for use in life-supporting or mission-critical environments. You are solely responsible for implementing appropriate backup systems, alarms, or procedures.

5. User Responsibilities

• You are responsible for ensuring your sensors are correctly installed and configured.
• You are responsible for ensuring your contact information is accurate and up to date.
• You are responsible for monitoring your own systems and responding appropriately to alerts.

6. Indemnification

You agree to indemnify, defend, and hold harmless Caltuck LLC from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use or misuse of the Service, your violation of this Agreement, or your failure to act on alerts or warnings.

7. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any violation of these Terms or misuse of the platform.

8. Limited Warranty

Caltuck LLC provides a limited warranty solely for the digital and programmatic operation of the sensor monitoring system. This warranty is limited to:

• Ensuring that the sensor device is connected and communicating with the Caltuck Cloud Monitoring platform
• Maintaining the operational status of backend systems used for processing, logging, and alerting

This warranty does not cover:

• Sensor accuracy or calibration drift
• Physical hardware damage due to misuse, tampering, vandalism, or environmental exposure
• Customer-side power or network disruptions
• Any failure to detect or alert about an event or condition

Caltuck LLC makes no warranty, express or implied, beyond the digital connectivity and software-based functionality of its systems. No guarantees are made regarding the prevention of damage, spoilage, or operational failures based on alerts (or lack thereof).

9. Governing Law

This Agreement shall be governed by the laws of the State of Colorado, without regard to conflict of law principles.

11. Monitoring, Maintenance, and Notification Policy

Caltuck LLC will provide its best effort to monitor sensor data and notify you in a timely manner if a temperature or connectivity event occurs. However, due to the nature of remote monitoring, we do not guarantee that all failures or conditions will be detected or that alerts will always be delivered without delay.

We are committed to maintaining the sensors and systems we provide. However:

• You are responsible for visually inspecting the hardware at your location on a regular basis.
• If you observe any physical damage, disconnection, tampering, or other hardware issues, you must report it to us through our support contact methods.
• A service request will only be initiated if such issues are reported.

Caltuck LLC is not liable for any damages, losses, or missed alerts resulting from power outages, internet failures, network disruptions, user misconfiguration, or physical damage that was not reported.

Caltuck LLC ("We", "Us" or "Our") operates the Caltuck Cloud Monitoring platform. This Privacy Policy explains how we collect, use, and protect your information when you opt in to receive SMS notifications.

1. Information We Collect

• Your mobile phone number
• Your name and account details (if provided during registration)
• Date, time, and method of your opt-in consent

2. How We Use Your Information

• Send temperature alerts, sensor notifications, and status updates
• Respond to help requests when you text HELP
• Manage your subscription preferences

We do not sell, rent, or share your phone number with unrelated third parties.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

3. How to Opt In

• Register for a Caltuck Cloud Monitoring account and check the consent box during sign-up
• Text START or SUBSCRIBE to our dedicated number

We store a record of your consent in your account profile.

4. How to Opt Out

• Reply STOP to any SMS message from us
• Update your notification preferences in your Caltuck Cloud Monitoring account

Once you opt out, you will no longer receive SMS alerts unless you re-subscribe.

5. Data Retention

We keep your phone number and consent records for as long as your account is active or until you request deletion.

6. Data Security

We use industry-standard encryption and security practices to protect your personal information from unauthorized access.

7. Message Frequency & Charges

Message frequency depends on your sensor activity and may vary. Standard message and data rates may apply according to your mobile carrier.

8. Changes to This Policy

We may update this Privacy Policy from time to time. The latest version will always be posted here.
